Welcome to Tomcom. Before you start shopping or browsing, take a minute to read through these terms. They cover the rules of the road when you use our website and buy from us. By placing an order or even just browsing tomcom.us, you're agreeing to everything below.

If anything here doesn't sit right with you, that's fine, just don't use the site.

Who Can Shop With Us

To order from Tomcom, you need to be at least 18 years old, or whatever the legal age is in your state. By checking out, you're confirming that you meet that age and have the legal right to enter into a contract with us.

If you're shopping on behalf of a business, you're also confirming you have authority to bind that business to these terms.

Product Info & Pricing

We do our best to keep everything on the site accurate, but mistakes can slip through. Here's how we handle it:

• Pricing errors. If a product gets listed at a clearly wrong price, we reserve the right to cancel the order or reach out to confirm at the correct price.
• Product photos. The images we show are for reference. Actual packaging or box artwork might look slightly different depending on the manufacturer's release.
• Stock availability. Just because something's on the site doesn't mean it'll always be in stock. We may limit quantities, run out of items, or discontinue products without notice.
• Quantity limits. For high-demand releases, we might cap how many one person or household can order, to keep things fair for everyone.

Placing an Order

Submitting an order at checkout doesn't automatically mean we've accepted it. We reserve the right to:

• Refuse or cancel any order at our discretion
• Verify your identity or payment info before shipping
• Decline orders that look fraudulent or suspicious
• Cancel orders if a product is out of stock or mispriced

If we cancel your order, we'll refund you in full, no questions asked.

Payment

• What we accept. Major credit and debit cards along with supported digital wallets.
• Currency. Everything is priced in U.S. Dollars (USD).
• When we charge. Payment is collected at the time you place your order, including pre-sales.
• If your payment fails. We hold onto orders for 48 hours while waiting for payment to clear. After that, we'll cancel the order automatically.

Pre-Sale Orders

A quick rundown on how pre-sales work at Tomcom:

• You pay the full amount upfront when you place the order
• Manufacturer release dates are estimates; they can shift, and that's outside our control
• Once a pre-sale releases, we ship within 1-2 business days
• Pre-sale orders can't be canceled or modified after placement
• If a manufacturer cancels a release entirely, you'll get a full refund

We always recommend pre-ordering big releases so you don't miss out.

We Sell Authentic Products

Every product on Tomcom comes from authorized distributors and manufacturers. We work with companies like Panini, Topps, and Upper Deck to make sure what you're buying is 100% factory sealed and genuine.

We have zero tolerance for counterfeit or unauthorized resale products. If you ever have any doubt about the authenticity of an item you received, contact us right away and we'll make it right.

Our Stuff Is Our Stuff

Everything on tomcom.us, including the logo, the layout, the product photos, the writing, and the brand name "Tomcom", belongs to Tomcom and is protected by U.S. copyright and trademark law.

You can browse, share, and shop. What you can't do:

• Copy our content for your own site or store
• Use our logo or brand name without written permission
• Scrape product data using bots or automated tools
• Reproduce our photos or descriptions elsewhere

If you want to use any of our content for legitimate purposes (like a review or feature), email us first. We're usually happy to help.

Things You Can't Do on Our Site

When you use Tomcom, you agree not to:

• Break any laws while using the site
• Try to hack, break, or disrupt our systems
• Use bots, scrapers, or automation to grab data or buy products in bulk
• Submit fake info at checkout
• Harass our staff or other customers in any way
• Resell our products in ways that violate manufacturer agreements
• Pretend to be someone else

If we catch you doing any of this, we can shut down your account and refuse future orders.

Limit of Our Liability

To the fullest extent allowed by law, Tomcom is not liable for:

• Indirect, incidental, or consequential damages
• Lost profits, lost data, or lost time
• Anything beyond the actual amount you paid for the product in question

In other words, our maximum liability is capped at the cost of your order. This is standard practice for online retailers.

No Guarantees on Sealed Products

We sell sealed products as-is. That means:

• We don't guarantee what specific cards, autographs, or memorabilia are inside
• We don't promise certain pulls, hits, or insertion ratios
• We don't warranty the contents beyond what the manufacturer provides

The chase is half the fun, we're just here to get you the boxes.

When Stuff Beyond Our Control Happens

If a delay or problem is caused by natural disasters, pandemics, government shutdowns, carrier strikes, or manufacturer supply issues, we're not liable for the delay. We'll always do our best to communicate and resolve things, but force majeure events happen.

Which Laws Apply

These terms are governed by the laws of the State of Colorado, USA. If there's ever a dispute we can't sort out directly, it has to be filed in the state or federal courts of El Paso County, Colorado.

Changes to These Terms

We may update these Terms of Service from time to time. The latest version always lives on tomcom.us with a fresh date at the top. Continuing to use the site after we update the terms means you accept the changes.

If One Part of This Is Unenforceable

If a court ever decides that one part of these terms isn't enforceable, the rest stays in full effect.
